P. Diddy Accused: How Does a Criminal Trial Work in America?

The world is waiting for the trial of PTD. How does such a procedure work and what can the rapper expect? Jürgen Rodegra, attorney and expert in American criminal law, provides answers.

Mr. Rodegra, Rob Mogul b. We've been hearing and reading a lot about the grand jury that brought up the indictments against DD. What is it, a grand jury? Are they the ones who will sit on the jury in the trial later?
No, most people know American court trials from television, where a jury sits and decides whether the defendant is guilty or innocent. This is completely different than a grand jury. A grand jury decides whether a complaint filed by the state attorney's office in court is admissible, meaning there is sufficient suspicion of a crime. It's really big, I mean big. There sit about 20 people, not experts, but citizens randomly selected from the street to represent the average people in society.

So, if the grand jury didn't find sufficient suspicion, why wouldn't PTD have been tried?
Yes, a grand jury will decide if this happens. Unlike in Germany, this is later decided by the judge conducting the trial. But grand juries are generally generous. It is rare that charges are not allowed to be filed. It must be complete nonsense.
