The government in Warsaw announced on Tuesday that the judges’ disciplinary body would be dissolved. The European Court of Justice has ruled that the body is inconsistent with the laws of the European Union. However, the Polish government wants to apply for the cancellation of the temporary injunction issued by the European Court of Justice.

The disciplinary body was introduced by the nationalist PiS government as part of a controversial judicial reform. The European Court of Justice has ruled that the new law does not meet all the requirements for the impartiality and independence of judges. In particular, these are not protected from the influence of the government or parliament. The country faces fines and a loss of financial aid from the European Union.

The Disciplinary Chamber in its current form has been dissolved

At the beginning of August, the head of the PiS, Jaroslav Kaczynski, announced that the disciplinary chamber in its current form would be dissolved. At the same time, he declares that he does not recognize the decision of the European Court of Justice because, in his opinion, it is beyond the decision-making power of the courts of the European Union. He announced that the government would press ahead with its plans to reform the controversial disciplinary body in September.
